1501. BENJAMIN RIMELL was indicted for stealiing, on the 8th of September, fourteen dozen of pottle baskets, value 7 s., the goods of Allen Malcolm.
ALLEN MALCOLM. I am a cowkeeper, and live at Brentford. My father is a market gardener; I had a number of baskets in my father's potatoe cave. The prisoner is his carter. I cannot swear to them.
HENRY MALCOLN. I am the prosecutor's brother. I was sitting in doors with my father, when a girl said there was some person among the pottles; I went out and found the prisoner in the stable, with the pottles among the horses.
JAMES MALCOLM. On hearing my female servant say there was some person among the baskets, I went out; I did not see the baskets in the stable, but I saw them afterwards in the potatoe cave - I am certain that they had been moved and put back again.
Cross-examined by MR. PHILLIPS. Q. Can you swear to these baskets? A. No.
HENRY MALCOLM re-examined. Q. Did you see the prisoner move any of these baskets? A. I did not see him bring them out; but I saw him take them back.
